Terms of Service

    Last updated: June 4, 2026 · Effective: June 4, 2026

    These Terms of Service ("Terms") are a binding agreement between you and Carbon Box AI LLC ("we", "us", "Advertisable") governing your use of the Advertisable self-serve platform at advertisable.ai (the "Service"). The Service uses artificial intelligence to generate video ads and related creative. You are the creator and publisher of the ads you make, and you are responsible for how you use them. Please read these Terms carefully — they include important limitations of liability and your responsibilities for consent, advertising claims, and required disclosures.

    1. Acceptance and eligibility

    By creating an account or using the Service, you agree to these Terms. You must be at least 18 years old. If you use the Service on behalf of a company, you represent that you have authority to bind it. You are responsible for your account credentials and for all activity under your account.

    2. What the AI does (plain language)

    The Service uses AI to generate UGC-style video ads, product showcases, testimonials, B-roll, and related creative, and to assemble them in an editor.

    • Outputs are machine-generated and probabilistic. They may be inaccurate, may contain errors, and may not be unique to you.
    • You must review outputs and verify their accuracy and legality before relying on or publishing them.
    • The Service is not designed for regulated decision-making and does not provide legal, medical, or financial advice.

    3. Definitions

    • "Content" means anything you upload or submit, including links, images, video, audio, scripts, logos, and brand assets.
    • "Outputs" means the creative the Service generates for you.
    • "Credits" means the units consumed to use generation features.

    4. Credits, subscriptions, and payment

    Generation features consume credits (for example, video generation, image generation, and AI/LLM calls). Credits are consumed at the time of generation regardless of whether you are satisfied with the output.

    • Credits are non-refundable once consumed, have no cash value, may expire, and cannot be resold.
    • Subscriptions renew automatically until cancelled. We will give notice of price changes. Taxes may apply.
    • If you cancel, you keep access through the end of the paid period; we do not refund consumed credits on a pro-rata basis.
    • Free-tier or trial limits, and what carries over, are described at sign-up.

    5. Ownership and rights in Outputs

    Subject to your payment in good standing, we grant you a broad, perpetual, worldwide, commercial license to use the Outputs you generate, and we assign to you any rights in those Outputs to the extent they are assignable.

    • The copyrightability of AI-generated material is uncertain. We make no warranty that Outputs are protectable by copyright or are unique to you.
    • The model may produce identical or similar outputs for other users. We grant no exclusivity.
    • Your rights in Outputs are conditioned on payment in good standing. You acquire no rights in Outputs generated under a charged-back, reversed, or fraudulent transaction.

    6. Your Content and our platform

    You retain ownership of your Content and grant us a license to host and process it solely to provide the Service. You represent and warrant that you own or are licensed to use everything you upload, and that our processing of it will not infringe anyone's rights.

    We own the Service, including our software, models, user interface, and underlying systems. You may not reverse engineer, scrape, extract our models, circumvent limits, or use the Service to build a competing product.

    7. AI training and data use

    We do not use your Content, prompts, or Outputs to train generalized AI models. We process them to provide and operate the Service. To generate Outputs, your inputs may be transmitted to third-party AI providers that process data under their own terms (see Section 11). Our Privacy Policy describes how we handle your data, and these Terms and the Privacy Policy are intended to be consistent.

    9. Acceptable use

    You may not use the Service to create, upload, or distribute content that:

    • Is illegal, defamatory, fraudulent, or infringing;
    • Impersonates a person or clones a likeness or voice without consent, or is a deceptive deepfake;
    • Is election or political campaigning content, or misinformation;
    • Is sexual content, involves minors, or is hateful, violent, or harassing;
    • Makes false or unsubstantiated advertising claims;
    • Promotes regulated goods (e.g. pharmaceuticals, health-claim supplements, financial or crypto products, gambling, weapons) without proper authorization;
    • Includes third-party personal or biometric data without consent;
    • Attempts model extraction, reverse engineering, scraping, or circumvention of limits; or
    • Violates the rules of the platform where you publish it (e.g. Meta, TikTok, YouTube).

    Violations may result in immediate suspension, content removal, forfeiture of credits, account termination, and, where appropriate, reporting to law enforcement or regulators.

    10. Advertising compliance and required disclosures

    Because the Service helps you create advertising — including UGC-style and testimonial ads — you are solely responsible for the truthfulness and legal compliance of your ad claims and for making all disclosures required by law in the ads you publish.

    • You must make any required material-connection disclosures and any required disclosure that an endorser or person in an ad is AI-generated (a "double disclosure" under FTC guidance).
    • You will not present AI-generated testimonials as genuine consumer experiences in violation of applicable law.
    • You are responsible for complying with synthetic-media and AI-disclosure laws that apply to your ads — including, for example, New York's synthetic-performer disclosure law (effective June 9, 2026) and California's AI-content labeling and metadata requirements.
    • We may apply AI-content labels or preserve provenance metadata on Outputs, and you must not remove or strip them.

    11. Third-party platforms and AI providers

    You are solely responsible for complying with the advertising policies of any platform where you run your ads (e.g. Meta, TikTok, YouTube). We are not responsible for ad rejections, account actions by those platforms, or the performance of your campaigns.

    The Service is built on third-party AI and infrastructure providers, and your inputs may be transmitted to them to generate Outputs. We may change providers and will update our disclosures accordingly.

    12. Disclaimers and no guarantee of results

    THE SERVICE AND ALL OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ACCURACY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

    We specifically disclaim liability for AI hallucinations, factual errors, model drift, and non-unique outputs. We do not guarantee any advertising results, sales, reach, ROAS, or platform approval. You must independently verify Outputs before publishing or relying on them.

    13. Indemnification

    You will defend, indemnify, and hold harmless us and our affiliates from any third-party claim, loss, or expense (including reasonable attorney's fees) arising from: your Content; your use of Outputs; lack of likeness or voice consent; advertising or endorsement violations; infringement in your inputs; or any breach of these Terms or our acceptable-use rules.

    14. Limitation of liability

    TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE FEES YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

    15. Payment disputes, chargebacks, and fraud

    If you have a billing concern, you agree to contact us at legal@advertisable.ai first before initiating a chargeback. Filing a chargeback for services rendered, without first contacting us, is a breach of these Terms.

    • A chargeback or payment reversal may result in immediate suspension or termination, forfeiture of your license to any affected Outputs, and liability for the disputed amount plus collection and reasonable attorney's fees.
    • We may suspend or refuse service on suspected fraud, payment abuse, or acceptable-use violations, and may reverse rights in Outputs tied to a fraudulent transaction.
    • Your commercial rights in Outputs are conditioned on payment in good standing.

    16. Moderation, takedowns, and termination

    We may moderate, remove content, and suspend or terminate accounts at our discretion for violations of these Terms. We maintain a notice-and-takedown process for rights-holders and depicted individuals. On termination, we handle your data and Outputs as described in our Privacy Policy and these Terms.

    17. Changes, governing law, and disputes

    We may update these Terms with notice; continued use means you accept the changes. These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws rules. Mandatory consumer-protection rights of EEA/UK and other consumers are not affected.

    [CONFIRM: include binding arbitration + class-action waiver? Default yes, subject to counsel; not enforceable the same way against EU consumers.] These Terms are the entire agreement between us, are severable, and may be assigned by us in connection with a merger or sale. Neither party is liable for events beyond its reasonable control.
